Louis Vuitton N. Am., Inc. v. Schenker S.A., 2019 WL 1507792 (E.D.N.Y. Mar. 31, 2019) – Obtained judgment on the pleadings dismissing claim for indemnification under article 10 of the Montreal Convention and staying action in favor of foreign proceedings.

PEMEX Exploración y Producción v. Murphy Energy Corp., 2014 WL 2446368 (S.D. Tex. May 30, 2014), aff’d sub nom. 595 Fed.Appx. 445 (5th Cir. 2015) – Obtained summary judgment and affirmance for defendant-appellee on claims alleging conversion of $30 million in natural gas condensate. 

Dingxi Longhai Dairy, Ltd. v. Becwood Tech. Group LLC, 635 F.3d 1106 (8th Cir. 2011) – Successful reinstatement of claims brought under the U.N. Convention on Contracts for the International Sale of Goods (CISG). 

Sompo Japan Ins. Co. of Am. v. B&H Freight, Inc., 177 F.Supp.3d 1084 (N.D. Ill. 2016) – Defeated motion to dismiss common law claims on the basis of preemption under the Carmack Amendment. 

Best Industries (Pvt) Ltd. v. Pegasus Maritime, Inc., 2013 A.M.C. 2028 (S.D.N.Y. June 7, 2013) – Defeated attempt by plaintiff and third-party defendant in COGSA action to dismiss claims brought by operation of Fed. R. Civ. P. 14(c) without the consent of defendant.
